Welcome to the terms and conditions ("Terms") for ASUSTOR Accessories Store. These Terms are between you and ASUSTOR Accessories Store, and govern our respective rights and obligations. The Terms, together with applicable terms and conditions related to any promotional offers provided to you for use with membership, constitute the entire agreement between you and ASUSTOR Accessories Store related to the membership. Please note that your use of the web site and membership of ASUSTOR Accessories Store are also governed by our Privacy Policy, as well as all other applicable terms, conditions, limitations and requirements on the ASUSTOR Accessories Store , all of which (as changed over time) are incorporated into these Terms.

Membership Benefits

Price displayed in the ASUSTOR Accessories Store is including the shipping cost. But local tax, levy and customs duty are the responsibility of the buyer. ASUSTOR Accessories Store members can take advantage of easy purchase accessories, directly delivered to their shipping address.

Conditions

You must have an ASUSTOR Accessories Store account to sign up for and use membership. We reserve the right to accept or refuse membership in our discretion. Please note:

• It will take approximately 5~10 days for ordered goods to be processed and delivered. The delivery time will differ based on the region in which you live.;
• We may ship the products by land or air at our discretion (these terms do not correspond to any carrier-branded shipping services);
• Our carriers usually do not pick-up or deliver packages on weekends or holidays;
• We do not guarantee delivery of products within the estimated transit time or by the estimated delivery date.
• The recipient of an international shipment may be subject to import taxes, customs duties and fees by the destination country. Such import taxes, customs duties and fees must be borne by the recipient.
• You are required to pay a return handling fee if you request a product return.
• You are required to pay a return handling fee and delivery fee if you request a product return in warranty.
• The warranty of Power Supply, Power Adapter and Remote Controller is 3 Months.
• The warranty of 10GbE Network Card is 2 years.
• The warranty of RAM module is 3 years.
• If mechanical parts (parts without any electrical or PCB components) are found to be defective, the customer shall contact ASUSTOR within two working days from the date of receipt for an exchange.

Disclaimers

General. ASUSTOR Accessories Store may revise these Terms at any time by updating this posting. You should visit this page from time to time to review the then-current Terms because they are binding on you. Certain provisions of these Terms may be superseded by expressly designated legal notices or terms located on particular pages at ASUSTOR Accessories Store.

1.ASUSTOR Accessories Products Availability & Discontinuance

Availability of the Products is limited and Products may not be available for immediate delivery. ASUSTOR Accessories Store reserves the right, without liability or prior notice, to revise or cease to make available any or all Products. If there is any revision or cessation, ASUSTOR Accessories Store may ship products which have the functionality and specifications of the Products ordered ("Substituted Products") but there will be differences in the specifications between what was shipped and what was ordered. Customer shall be deemed to have accepted such differences if Customer accepts delivery of the Substituted Products.

2.No Returns or Exchanges

Products ordered and/or delivered cannot be returned or exchanged, unless otherwise agreed by ASUSTOR Accessories Store, at its sole discretion. All orders placed at the ASUSTOR Accessories Store may not be cancelled by Customer.

3.Warranty

• Your ASUSTOR Accessories Store product is covered by this Warranty Service under the specified warranty period starting from the original purchase date. Proof of the original purchase date is required for this Warranty Service.
• ASUSTOR will inspect the ASUSTOR Accessories Store product and in its sole discretion repair or replace it with a new or a refurbished product. ASUSTOR may also provide a functionally equivalent replacement, or refund or credit the current value of the ASUSTOR Accessories Store product at the time the warranty claim is made. The decision made by ASUSTOR shall be final and binding upon you.
• Any products or accessories replaced for the purpose of carrying out this warranty service are considered properties of ASUSTOR and shall not be returned. (Chargeable repairs included.)
• ASUSTOR may refuse to provide inspection, repair or replacement service for ASUSTOR Accessories Stores products that are out of this Warranty Service, and will charge fees if still exceptionally adopt this Warranty Service.
• The new, refurbished or functionally equivalent product provided by ASUSTOR under the Warranty Service will be warranted for the remainder of the original warranty period.
• ASUSTOR’s liability shall not exceed the purchase price of the product paid by the customer.
• A limited warranty statement will be included with ASUSTOR Accessories Store product shipped to Customer. ASUSTOR Accessories Store reserves the right to modify its warranty statement at any time, at its sole discretion. ASUSTOR Accessories Store will be obligated to honor any such warranty only upon ASUSTOR Accessories Store's receipt of the payment in full for the product to be warranted.

3.1 Limitations

• This Warranty Service does not apply to any inaccessible or lost data or any ASUSTOR Accessories Store product failure caused by any force majeure event, accident, abuse, mishandling or improper usage (including the use contrary to the product description or instructions, outside the scope of the product's intended use, for tooling or testing purposes, or product modification), alteration of components/accessories, abnormal mechanical or environmental conditions (including prolonged exposure to humidity or extreme temperature), acts of nature, improper installation (including connection to incompatible equipment), problems with electrical power (including undervoltage, overvoltage, power supply instability, or lithium battery being charged for too long), abnormal internet connection or other similar factors.
• This Warranty Service shall not apply to the transferees of the ASUSTOR Accessories Store products and/or anyone who stands to profit from this Warranty Service without ASUSTOR's prior written authorization.

4.Application of terms and conditions of sale

The following terms and conditions shall govern the sale by the ASUSTOR Inc., entity named on the invoice that will be provided to Customer of Spare Parts and/or related products sold by ASUSTOR Inc. ("Products"), unless (a) Customer has signed a separate formal purchase agreement with ASUSTOR Inc., in which case the terms and conditions of the separate agreement shall govern or (b) unless other standard ASUSTOR Inc. terms and conditions apply to the transaction. By ordering the Products and/or accepting delivery of the Products described on the invoice, Customer agrees to be bound by and accepts these terms and conditions. ASUSTOR Inc. reserves the right to change these terms and conditions without prior written notice at any time, at ASUSTOR Accessories Store's sole discretion.

5.Payment Terms

Terms of payment shall be determined at ASUSTOR Accessories Store's discretion and unless otherwise agreed to by ASUSTOR Accessories Store, payment shall be made by Customer prior to ASUSTOR Accessories Store's acceptance of Customer's order. Payment shall be made by credit card or some other pre-arranged methods of payment acceptable to ASUSTOR Accessories Store. Where payment is made by credit card, such payment is subject to the approval of the financial institution issuing the credit card and ASUSTOR Accessories Store shall not be liable in any way if such financial institution refuses to accept or honor the credit card for any reason. If credit term have been agreed by ASUSTOR Accessories Store, Customer shall pay invoices within thirty (30) days from the date of the invoices or such period which may be agreed in writing between Customer and ASUSTOR Accessories Store.

6.Other documents do not apply

Any term or condition of Customer's order which is any way inconsistent with or in addition to these terms and conditions shall not be applicable or binding on ASUSTOR Accessories Store, unless otherwise agreed in a written agreement signed by Customer and ASUSTOR Accessories Store and ASUSTOR Accessories Store's failure to object shall not be considered a waiver of these terms and conditions. These terms and conditions may not be supplemented, altered or modified by the use of any other document(s). Any attempt to modify, supplement or amend these terms and conditions will be null and void, unless agreed in writing by ASUSTOR Accessories Store.

7.Exclusion & Limitation of Liability

For any breach of these terms and conditions, ASUSTOR Accessories Store's sole and exclusive maximum liability shall not in any event exceed the total price of the products ordered by Customer. In no event shall ASUSTOR Accessories Store be liable to customer or any third party for any special, indirect, consequential or punitive loss or damage for any breach of these terms and conditions, including but not limited to loss of profits, loss of business or goodwill, loss of use even if ASUSTOR Accessories Store has been advised of the possibility of such loss or damage of any claim by any third party. ASUSTOR Accessories Store shall not be liable if it is unable to perform any of its obligations contained in these terms and conditions due to, directly or indirectly, to the failure of any machine, system of authorization, data processing or communication system or transmission link or any industrial dispute, war, flood, explosion, act of god or any other event beyond the control of ASUSTOR Accessories Store. If any service is performed by any third party or authorized by ASUSTOR Accessories Store, ASUSTOR Accessories Store shall not be liable for any act, neglect, omission or willful default of such third party.

8.Governing Law & Jurisdiction

The sale of the Products shall be governed by the laws of R.O.C. Customer and ASUSTOR Accessories Store shall submit to the non-exclusive jurisdiction of Taipei distinct courts in Taiwan.

9.Export Control

All sales are subject to the export, import and other trade-related laws and regulations of the Taiwan and other national governments and the Customer herein acknowledges and agrees to be bound by the same.
